Terms of Business

These Terms and Conditions ("Terms") govern the provision of recruitment services ("Services") by Jobs In Zanzibar (TZ Digital Company Ltd) ("Recruitment Agency") to its clients ("Client").

By engaging the Services of the Recruitment Agency, the Client agrees to be bound by these Terms.

The Recruitment Agency agrees to provide recruitment services, including but not limited to, the identification, screening, and introduction of Candidates to the Client, in accordance with these Terms.

Services may include, depending on the engagement agreed with the Client:

• Advertising vacancies on JobsInZanzibar.com and associated channels;
• Sourcing and approaching candidates, including head-hunting where agreed;
• Screening CVs and applications against the Client's requirements;
• Conducting initial candidate interviews and assessments;
• Presenting a shortlist of suitable candidates to the Client;
• Conducting reference checks where agreed; and
• Supporting the Client during the offer and onboarding process.

In order for Jobs In Zanzibar to provide effective recruitment services, the Client shall:

The Recruitment Agency shall charge fees for its Services as agreed upon in a separate agreement between the Recruitment Agency and the Client.

The Client agrees to pay all reasonable expenses incurred by the Recruitment Agency in providing the Services, provided such expenses have been approved in advance by the Client.

In the event that the Client engages or employs a Candidate introduced by the Recruitment Agency without prior consent from the Recruitment Agency or without an agreement in place, the Client shall be liable to pay a fee set at the discretion of the Recruitment Agency.

This clause applies regardless of:

• The time elapsed since the original introduction;
• Whether the Candidate was initially declined by the Client;
• Whether the engagement is for the same role or a different position; or
• Whether the engagement is as an employee, contractor, consultant or in any other capacity.

Both parties agree to keep all information regarding Candidates and the Services strictly confidential and not to disclose such information to any third party without prior written consent, except as required by law.

Confidential information includes, but is not limited to:

• Candidate CVs, profiles, salary expectations and personal details;
• Interview notes, assessments and screening results;
• The terms of any recruitment arrangement between the parties;
• Any commercially sensitive information shared by either party; and
• The identities of candidates being considered for positions.

The Recruitment Agency does not accept liability for any direct, indirect, or consequential loss or damage arising from the employment or engagement of a Candidate by the Client.

This includes but is not limited to:

• Loss of profits, business, revenue or goodwill;
• Loss of anticipated savings;
• Any claims arising from a Candidate's conduct, performance or suitability;
• Any loss arising from inaccurate information provided by the Candidate; and
• Any employment disputes or tribunal proceedings involving a placed Candidate.

These Terms shall be governed by and construed in accordance with the laws of Zanzibar, Tanzania.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Zanzibar, Tanzania.

These Terms may be amended or modified by the Recruitment Agency from time to time without prior notice.

The Client agrees to be bound by any such amendments or modifications. The current version of these Terms will always be published on JobsInZanzibar.com.

These Terms constitute the entire agreement between the Recruitment Agency and the Client regarding the subject matter hereof and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.

No representation, warranty or undertaking not expressly set out in these Terms shall be binding on either party, unless confirmed in a separate written agreement signed by both parties.

By engaging the services of the Recruitment Agency, the Client agrees to be bound by these Terms and Conditions.

These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral.
